Legal Rights and Protections Under the SCRA
Servicemembers on “active duty” or “active service,” or their spouse or dependents, may be entitled to certain legal protections and debt relief under the Servicemembers Civil Relief Act (SCRA) [50 USC §§ 3901-4043].
Who May Be Entitled to Legal Protections Under the SCRA?

Regular members of the U.S. Armed Forces (Air Force, Army, Coast Guard, Marine Corps, Navy, and Space Force)

Reserve and National Guard personnel who have been activated and are on Federal active duty
-
National Guard members under Title 32, Section 502(f) orders for more than 30 consecutive days (responding to a federally supported national emergency)

Active service members of the Public Health Service and NOAA Commissioned Corps
-
Certain U.S. citizens serving with allied armed forces in a war or military action
What Legal Protections Does the SCRA Provide?

6% Interest Rate Cap: Debts (including mortgages) incurred prior to military service may not bear interest above 6% during active duty and, in some cases, for one year afterward.

Protection from Foreclosure: In legal actions to enforce a debt against real estate, courts may postpone proceedings or adjust debts.

A sale, foreclosure, or seizure of real estate is invalid during or within one year after service unless ordered by a court.

Other Protections: Additional safeguards apply to various civil obligations beyond home loans.
How to Request SCRA Relief
To request relief under the SCRA, the servicemember or spouse should:

Important Notes for Foreclosure or Debt Enforcement
There is no requirement for a servicemember to notify the lender before foreclosure or debt enforcement. However:

Lenders should search the Defense Manpower Data Center (DMDC)

Review internal files for military service indicators
-
Contact the servicemember when applicable
Although not required, servicemembers are encouraged to inform their lender of military status.
